1. About these terms
These terms apply when you use avitrace.net (“Avitrace”, “we”, “us”). By using the site, or creating an account, you agree to them. Please also read our privacy policy, and the photo licence if you submit photos to the Avitrace gallery.
2. Your account
- You must be 13 or over to create an account.
- Give accurate details and keep your email address up to date, as we use it to reach you about your account.
- An account is for one person. Keep your password to yourself; you’re responsible for what happens on your account.
- Choose a username and display name that don’t impersonate anyone or cause offence.
3. Contributing to aircraft records
Avitrace’s records are built by its members. When you add or edit information:
- Make it accurate to the best of your knowledge, and give a source where you can.
- Only add information that’s publicly available or that you’re free to share. Don’t share anything that’s classified, restricted or that could put people or operations at risk.
- Records are collaborative: other members and editors may change, correct or remove what you add.
Facts about aircraft aren’t owned by anyone, but to the extent your contributions (such as descriptions and notes) are protected, you give Avitrace a permanent, worldwide, royalty-free licence to use, edit and publish them as part of its records. This lets the history of each aircraft stay complete even if you later leave.
4. Photos
- You keep the copyright in your photos.
- Personal gallery: photos you upload are stored for you, and shown on your profile only if you choose. By uploading, you let us store them and show them as your settings allow.
- The Avitrace gallery: submitting a photo for the official gallery means accepting the photo licence. Editors review photos against our standards and can decline them; this doesn’t affect your personal gallery.
- Only upload photos you took, or have the rights to, and that were taken legally, including on airfields and military sites.
- Free accounts have a limit on personal-gallery photos. Photos accepted into the Avitrace gallery don’t count towards it.
5. Comments and conduct
Be respectful. Don’t post anything that:
- is abusive, harassing, hateful, threatening or sexually explicit;
- is unlawful, infringes someone else’s rights, or shares other people’s personal information without permission;
- is spam, advertising or misleading;
- encourages trespass or breaking airside, security or photography restrictions.
Don’t try to break, overload or get around the security of the site, and don’t scrape or bulk-copy it without our permission.
6. Moderation
Our editors keep Avitrace accurate and welcoming. We may edit or remove content, decline photos, or suspend or close accounts that break these terms. Where it’s fair to, we’ll tell you why. If you think we’ve made a mistake, email [email protected].
7. Supporter subscriptions
- Supporters pay a monthly or yearly subscription for extra features, such as the full history of every aircraft and an unlimited personal gallery. The price and features are shown before you subscribe.
- Payments are taken by Stripe. Your subscription renews automatically until you cancel.
- You can cancel at any time. You keep your supporter features until the end of the period you’ve paid for.
- You have 14 days after first subscribing to change your mind and get a refund. Because your supporter features start straight away, we may deduct an amount for the time you’ve already had them.
- If we change the price, we’ll tell you in advance, and the change will apply from your next renewal. You can cancel before then.
8. Accuracy of information
We work hard to keep records accurate, but they’re compiled by enthusiasts from public sources and can be incomplete or wrong. Avitrace is for interest and reference only. Don’t rely on it for operational, safety, legal or commercial decisions.
9. Our content and data
The Avitrace name, logo, design and the compiled database belong to Avitrace. You may view and share individual pages for personal, non-commercial use. Please ask us before reusing our data in bulk or for commercial purposes. Photos belong to their photographers and are used under licence.
10. Our responsibility to you
We provide Avitrace “as is” and can’t promise it will always be available or free of errors. Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law doesn’t allow us to limit, and nothing affects your legal rights as a consumer.
Otherwise, we’re not responsible for losses that weren’t foreseeable, for business losses, or for content posted by other members. If we are responsible for a loss, our total liability is limited to the amount you’ve paid us in the 12 months before it happened.
11. Ending your account, and changes
You can stop using Avitrace at any time, and ask us to delete your account by emailing us. What happens to your information is explained in our privacy policy.
We may change these terms. If a change is significant, we’ll update the date at the top and tell you before it takes effect. If you keep using Avitrace afterwards, the new terms apply.
12. Law and contact
These terms are governed by the law of England and Wales. If you live elsewhere in the UK, you can also bring a claim in your local courts.
